Telesign Corporation and its affiliates (“Telesign”, “we”, “us”, or “our”) respect the privacy rights of individuals and are committed to handling personal information responsibly and in accordance with applicable law. Pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (“CCPA”), we are required to provide California job applicants with a privacy policy that contains a comprehensive description of our online and offline practices regarding our collection, use, sale, sharing, and retention of their Personal Information (defined below) as well as a description of the rights they have regarding their Personal Information.

This California Job Applicant Privacy Notice (“Notice” or “Privacy Notice”) provides the information the CCPA requires as well as other useful information regarding our collection and use of Personal Information. This Notice applies to any California resident who applies for a job role, or who otherwise seeks to carry out work with or for us whether on a permanent or non-permanent basis (“applicant/s”, “you”, or “your”).

This Privacy Notice does not apply to individuals who are not California residents. This Privacy Notice also does not apply to our collection and use of your Personal Information in a consumer or business-to-business capacity. Finally, this Notice does not form part of any contract of employment or other contract to provide services.

We may update this Notice from time to time in response to changing legal, technical or business developments. When we update this Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make. You can see when this Notice was last updated by checking the “last updated” date displayed at the top of this Notice.

WAIVER OF LIABILITY AND RELEASE: By participating in the Drawing and submitting an Entry, each entrant waives, discharges and fully releases Sponsor, the Related Entities, and any other companies associated with the Drawing, and all of their respective officers, directors, employees, agents and representatives, from any and all liability, injury, damage or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the Drawing or from the receipt or use of any prize or from any activity related to the receipt or use of any prize. By receipt of a prize, each prize winner agrees to release and hold harmless the Sponsor and the Related Entities from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Drawing or receipt or use or misuse of such prize.‍ 

PUBLICITY: Except where prohibited, each prize winner, by acceptance of a prize, grants to the Sponsor and the Related Entities the right to publicize the prize winner’s name (first name and last initial), social media handle(s), address (city and state of residence), photograph, voice, statements and/or other likeness/persona and prize information in any and all media now known or hereafter devised, for commercial and non-commercial advertising, trade and other purposes, throughout the world, in perpetuity, in any manner, without limitation and without additional compensation, consideration, notification or permission, unless prohibited by law. ‍ 

LIMITATIONS OF LIABILITY: Sponsor is not responsible for stolen, late, incomplete, inaccurate, misdirected, lost, damaged, or garbled Entries, messages or e-mail; for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), application, or other connections; availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines; or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Drawing, including, without limitation, errors or difficulties which may occur in connection with the administration of the Drawing, the processing of Entries, the announcement of prize, functionality of the application or in any Drawing-related materials. The Sponsor is also not responsible for any incorrect or inaccurate information, whether caused by entrant, tampering, hacking, or by any applications, equipment or programming associated with or utilized in the Drawing. The Sponsor is not responsible for injury or damage to entrant’s or to any other person’s mobile device related to or resulting from participating in this Drawing or downloading materials from or use of any application. Persons who tamper with or abuse any aspect of the Drawing or any application or attempt to undermine the legitimate operation of the Drawing by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor and/or the Related Entities, or who are in violation of these Official Drawing Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Any attempt to deliberately damage the content or operation of this Drawing is unlawful and subject to legal action by the Sponsor, and their respective agents. Sponsor’s failure to enforce any term of these Official Drawing Rules shall not constitute a waiver of that provision. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Drawing Rules or any applicable laws relating to the Drawing and to resolve all disputes in its sole discretion. ‍ 

GENERAL CONDITIONS: Sponsor reserves the right, in its sole discretion, to cancel, suspend and/or modify the Drawing. ‍ 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE APPLICATION OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS DRAWING IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. DISPUTES: By entering the Drawing, each Entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Drawing, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Drawing, and in no event will entrant be entitled to receive attorneys’ fees or other legal costs; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS DRAWING, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY — WITHOUT RESORT TO ANY FORM OF CLASS ACTION — BY BINDING ARBITRATION (BY A SINGLE NEUTRAL ARBITRATOR SELECTED BY SPONSOR IN ITS SOLE AND ABSOLUTE DISCRETION) IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION; AND ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT SHALL SUCH CLAIMS, JUDGMENTS OR AWARDS INCLUDE ATTORNEYS’ FEES. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.‍

Personal Information does not include publicly available, deidentified, or aggregated information or lawfully obtained, truthful information that is a matter of public concern. For purposes of this Privacy Notice, we will refer to this information as “Personal Information.”

Personal Information Collected from You

Below are the categories of Personal Information we currently collect for purposes of providing employment opportunities and, in the 12 months prior to the latest version of this Privacy Notice, have collected from past and current applicants. Please note that the Personal Information we collect depends on the position for which you apply, what information you choose to provide, and what information we are required to collect. Not all Personal Information listed below is collected from all past and current applicants.

Identifiers and personal details: your name, email address, postal address, and telephone number
Recruitment and selection information: your education information, professional or employment-related information (including employment history and previous applications to or employment with Telesign)
Characteristics of protected classifications under California or federal law: your racial/ethnic origin; ; sex/gender; disability; citizenship or immigration status; and military or veteran status
Sensitive Personal Information: Personal Information that reveals an individual’s Social Security, racial/ethnic origin, gender and disabilities.

Sources of Personal Information

We collect Personal Information directly from you (California residents) and from background checks; recruiters; staffing companies; references; former employers; educational institutions; online providers (such as through LinkedIn and similar providers); government entities; employees; business partners; and social networks. We do not collect all categories of Personal Information from each source.

We collect and use this Personal Information primarily for recruitment purposes – in particular, to determine your qualifications for employment and to reach a hiring decision. This includes assessing your skills, qualifications and background for a particular role, verifying your information, carrying our reference checks or background checks (where applicable) and to generally manage the hiring process and communicate with you about it.

If you are accepted for a role at Telesign, the information collected during the recruitment process will form part of your ongoing staff member record and will be processed in accordance with our California Employee Privacy Notice, which will be provided to you at the relevant time.

If you are not successful, we may still keep your application to allow us to consider you for other suitable openings within Telesign in the future unless you request that we delete your application.

We take care to allow access to Personal Information only to those who require such access to perform their tasks and duties, and to service providers who have a legitimate purpose for accessing it. Whenever we permit a trusted service provider to access Personal Information, we will implement appropriate measures to ensure the information is used in a manner consistent with this Notice and that the security and confidentiality of the information is maintained.

The following table identifies the categories of Personal Information that we disclosed for a business purpose in the 12 months preceding the latest version of this Privacy Notice and, for each category, categories of recipients to whom we disclosed Personal Information.

We disclosed Personal Information to the above categories of recipients for all of the business or commercial purposes described in the above “Purposes for Collection” section.

We have not sold or shared Personal Information in the twelve (12) months preceding the latest version of this Privacy Notice. We do not knowingly collect, sell, or share the Personal Information of individuals under 16 years of age. Personal Information Retention

We will keep your Personal Information for as long as is needed to carry out the purposes we’ve described above, and as otherwise required by applicable law. Generally, this means where you become our employee, we will keep your Personal Information in accordance with the retention periods set out in our Employee Privacy Notice. Otherwise, after confirmation that your application was unsuccessful, for a period of 3 years unless you request that we delete your application.

When we have no continuing legitimate business interest to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

WAIVER OF LIABILITY AND RELEASE: By participating in the Drawing and submitting an Entry, each entrant waives, discharges and fully releases Sponsor, the Related Entities, and any other companies associated with the Drawing, and all of their respective officers, directors, employees, agents and representatives, from any and all liability, injury, damage or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the Drawing or from the receipt or use of any prize or from any activity related to the receipt or use of any prize. PUBLICITY: Except where prohibited, each prize winner, by acceptance of a prize, grants to the Sponsor and the Related Entities the right to publicize the prize winner’s name (first name and last initial), social media handle(s), address (city and state of residence), photograph, voice, statements and/or other likeness/persona and prize information in any and all media now known or hereafter devised, for commercial and non-commercial advertising, trade and other purposes, throughout the world, in perpetuity, in any manner, without limitation and without additional compensation, consideration, notification or permission, unless prohibited by law. ‍ 

LIMITATIONS OF LIABILITY: Sponsor is not responsible for stolen, late, incomplete, inaccurate, misdirected, lost, damaged, or garbled Entries, messages or e-mail; for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), application, or other connections; availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines; or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Drawing, including, without limitation, errors or difficulties which may occur in connection with the administration of the Drawing, the processing of Entries, the announcement of prize, functionality of the application or in any Drawing-related materials. The Sponsor is also not responsible for any incorrect or inaccurate information, whether caused by entrant, tampering, hacking, or by any applications, equipment or programming associated with or utilized in the Drawing. The Sponsor is not responsible for injury or damage to entrant’s or to any other person’s mobile device related to or resulting from participating in this Drawing or downloading materials from or use of any application. Persons who tamper with or abuse any aspect of the Drawing or any application or attempt to undermine the legitimate operation of the Drawing by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor and/or the Related Entities, or who are in violation of these Official Drawing Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Any attempt to deliberately damage the content or operation of this Drawing is unlawful and subject to legal action by the Sponsor, and their respective agents. Sponsor’s failure to enforce any term of these Official Drawing Rules shall not constitute a waiver of that provision. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Drawing Rules or any applicable laws relating to the Drawing and to resolve all disputes in its sole discretion. ‍

To do so, we will ask you to verify data points based on information we have in our records concerning you.
